There’s growing interest in how artificial intelligence (AI), machine learning (ML), and predictive analytics can streamline subrogation, arbitration, and claims processes. In response to recent questions, we’d like to remind our members of AF’s Terms of Use on the use of AI:

Terms of Use
AF’s Terms of Use state:

You do not have permission, express or implied, to use the Services to populate, process, input, use or upload Data and Information into any artificial intelligence (‘AI’) technologies, including, but not limited to, large language models, generative AI, or for training a machine learning or AI system, without the express written permission of AF. If there is a specific AI use case that you would like AF to consider, please contact us at Legal@arbfile.org.

Arbitration Decisions
According to AF’s Neutrality Statement, arbitration decisions must be made by the arbitrator (human decision) based on the facts and applicable law:

This decision is according to my understanding of the current local law and the facts presented.

Use of AI Tools
Arbitrators must not upload case information into an AI tool to generate or influence the decision itself.
