Filing and Responding Parties Workshop Webinar – February 2023

AF recently facilitated a workshop webinar for Filing and Responding parties on February 15 and 16. The purpose of these 30-minute workshops is to drive decision quality by:
  1. Sharing information to improve the filing and responding process; and
  2. Answering questions regarding filing and responding to cases.
The latest workshop focused on writing concise arguments for liability and damages, avoiding template arguments, and properly admitting liability when not actually in dispute.

The following key takeaways were discussed during the February workshop.

Filing Party
  • Write liability contentions specific to the loss in question and keep them concise.
  • Properly itemize damages, including total loss breakdowns and salvage recovery/expenses.
  • Attach evidence to the appropriate section and use proper titles.
  • Raise damage rebuttals in the proper section, not as liability contentions.
Responding Party
  • Admit liability if there is no dispute and avoid “Rule 4-1 style” arguments.
  • Provide support for non-involvement defenses.
  • Keep both liability and damage disputes concise and to the point.
  • Clearly define the amount of the proposed reduction.
  • Avoid template arguments and paragraphs related to claims theory.
